Data Processing Agreement
To efficiently manage recruitment processes, we use an applicant management system provided by Personio SE & Co. KG, Seidlstraße 3, 80335 Munich, Germany (Contact: datenschutz@personio.de).
Personio processes your personal data on our behalf as a processor within the meaning of Art. 28 GDPR. We have concluded a legally compliant Data Processing Agreement (DPA) with Personio, ensuring that your data is processed exclusively in accordance with our instructions, treated confidentially, and stored on servers located within the European Union (EU) or the European Economic Area (EEA).
For exercising your data subject rights and for matters relating to the application process, we remain your primary point of contact. You may contact us directly using the details above or, where applicable, confidentially contact our Data Protection Officer.
Purpose of Data Processing
We process the data you provide during your application in order to assess your suitability for the respective position (or other suitable vacancies within our company) and to carry out the recruitment process.
What Data Do We Collect?
As part of the online application process through our application form, the following personal data is collected and processed:
Personal data: First name, last name, email address, telephone number.
Application documents: CV/resumé, cover letter, references, certificates, salary expectations, and availability.
Optional information: LinkedIn/Xing profile, photograph, or additional documents voluntarily uploaded by you.
Technical data: When accessing the recruiting website, log data is automatically transmitted (e.g., IP address, server logs, cookies), which is technically necessary for the secure operation of the website.
Legal Basis for Processing
The processing of your data is based on the following legal grounds:
Pre-contractual measures related to employment: Art. 6(1)(b) GDPR in conjunction with Section 26(1) German Federal Data Protection Act (BDSG) for conducting the application process.
Consent (e.g., talent pool): Art. 6(1)(a) GDPR, where you expressly consent to your data being stored for a longer period.
Legitimate interests: Art. 6(1)(f) GDPR where processing is necessary for the establishment, exercise, or defense of legal claims arising from the application process (e.g., under the German General Equal Treatment Act (AGG)).
Use of the HR Management System "Personio"
We use the HR software provided by Personio SE & Co. KG (Seidlstraße 3, 80335 Munich, Germany) to manage and administer the recruitment process.
Personio processes your personal data on our behalf as a processor pursuant to Art. 28 GDPR. We have concluded a legally compliant Data Processing Agreement (DPA) with Personio to ensure that your data is processed only according to our instructions, treated confidentially, and stored on servers within the European Union (EU) or the European Economic Area (EEA).
Retention Period and Anonymization
Rejected applications: If the recruitment process ends with a rejection, your personal data will generally be deleted or fully anonymized in Personio six (6) months after completion of the recruitment process. This retention period serves to fulfill legal documentation and defense obligations in the event of legal disputes (e.g., under the AGG).
Talent Pool: If we would like to retain your application for future job opportunities, this will only occur with your explicit consent. In such cases, your data will be stored for twelve (12) months unless you withdraw your consent earlier.
Successful application: If your application is successful, your application data will be transferred to your regular digital personnel file.Your Rights as a Data Subject
You have the right at any time to:
Obtain access to your personal data (Art. 15 GDPR),
Request correction of inaccurate data (Art. 16 GDPR),
Request deletion of your data (Art. 17 GDPR),
Request restriction of processing (Art. 18 GDPR),
Receive your data in a portable format (Art. 20 GDPR),
Withdraw any consent previously given (Art. 7(3) GDPR).
You also have the right to lodge a complaint with a supervisory data protection authority (Art. 77 GDPR).
As part of the application process and/or the use of the system, processing activities may also take place based on our legitimate interests pursuant to Art. 6(1)(f) GDPR or on the basis of your consent pursuant to Art. 6(1)(a) GDPR. Processing may also occur where there is a legal obligation or a public interest pursuant to Art. 6(1)(c) and (e) GDPR, for example in connection with criminal investigations or requests from public authorities.
